LEGAL WARRANTY AND RETURNS

Returned products must be perfectly packaged with the original boxes, on a sealed pallet – as in delivery – to avoid damage during transport. The return is possible within 7 calendar days from the date of receipt of the product. In case of apparent damage to the pallet, boxes or products, please contact Amatile within 24 hours from the time of delivery. All claims must include photos. The corresponding refund will be issued in the same form of payment with which the customer paid the amount of the material. The initial transport service to the delivery address indicated by the customer will not, under any circumstances, be refunded. It is recommended to check the goods at the time of receipt before any handling. In the event that the products have suffered any damage or breakage during shipping, what happened must be recorded on the carrier’s delivery note. For the correct processing of any claim, the carrier’s delivery note will be consulted and the customer will be asked to provide photos and/or videos of the material prior to any handling. In any case, no claims of any kind will be accepted after 14 calendar days from the receipt of the goods. The User, as a consumer and user, enjoys guarantees on the products that may be purchased through this Website, under the terms legally established for each type of product, AMATILE S.L. is therefore responsible for the lack of conformity of the same that is manifested within a period of two years from the delivery of the product. In this sense, it is understood that the products are in conformity with the contract provided that: they conform to the description made by AMATILE S.L. and possess the qualities presented therein; are suitable for the uses to which products of the same type are ordinarily intended; and present the usual quality and performance of a product of the same type and that are fundamentally expected from it. When this is not the case with respect to the products delivered to the User, the User must proceed as indicated in the Returns section. However, some of the products marketed on the Website may have non-homogeneous characteristics as long as these derive from the type of material with which they have been manufactured, and therefore they will form part of the individual appearance of the product, and will not be a defect. On the other hand, it may be the case that the User acquires a product of a brand or manufacture of a third party on the Website . In this case, and considering that it is a defective product, the User also has the possibility of contacting the brand or manufacturer responsible for the product to find out how to exercise their legal warranty right directly against them. To do this, the User must have kept all information in relation to the warranty of the products.

The following are exempt from all liability:

a) If the product has not been installed, maintained and cleaned in accordance with the instructions on the product, included in each product.

b) If the product has not received the expected use for the type of product.

c) If it assembles non-original parts or shows signs of improper handling.

d) If the defects are the result of the installation.

e) If the elements claimed are those subject to wear and tear and this is the normal one for the given use.

f) If the defect is caused by aggressive external elements (chemicals, corrosive cleaning products, installation in aggressive environments, excess limescale, ice, etc.)

g) If the defect is caused by environmental circumstances (pressure variations, extreme temperatures, etc.)

– Unless otherwise provided by law, AMATILE S.L. will not accept any liability for the following losses, regardless of their origin:

(a) Any losses not attributable to any breach by you

(b) Business losses (including loss of profits, revenue, contracts, anticipated savings, data, loss of goodwill or unnecessary expenses incurred); or

c) Any other indirect loss that was not reasonably foreseeable by both parties at the time the contract for the sale of products was concluded between both parties.

– Likewise, AMATILE S.L. also limits its liability in terms of the following cases:

a) AMATILE S.L. applies all measures concerning providing a faithful display of the product on the Website, however, it is not responsible for the slightest differences or inaccuracies that may exist due to lack of screen resolution, or problems with the browser used or others of this nature.

b) AMATILE S.L. will act with the utmost diligence in order to make the product subject of the purchase order available to the company in charge of transport. However, it is not responsible for damages arising from a malfunction of transport, especially for causes such as strikes, traffic jams, and in general any other specific to the sector, which result in delays, losses or theft of the product.

c) Technical failures that, for fortuitous reasons or of another nature, prevent the normal operation of the service through the Internet. Unavailability of the Website for maintenance or other reasons, which prevents the service from being available. AMATILE S.L. puts all the means at its disposal in order to carry out the process of purchase, payment and shipping/delivery of the products, however, it is exempt from liability for causes that are not attributable to it, fortuitous event or force majeure.

d) AMATILE S.L. will not be responsible for the misuse and/or wear and tear of the products that have been used by the User. At the same time, AMATILE S.L. will not be responsible for an erroneous return made by the User. It is the User’s responsibility to return the correct product.

– In general, AMATILE S.L. will not be liable for any breach or delay in the fulfilment of any of the obligations assumed, when it is due to events that are beyond its reasonable control, i.e. due to force majeure, and this could include, but is not limited to:

a) Strikes, lockouts or other industrial action or civil commotion, revolt, invasion, terrorist threat or attack, war, (declared or not) or threat or preparations for war.

(b) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster

c) Impossibility of using trains, ships, planes, motor transport or other means of transport, public or private.

d) Impossibility of using public or private telecommunications systems.

(e) Acts, decrees, legislation, regulations or restrictions of any government or public authority.

In this way, the obligations will be suspended during the period in which the force majeure event continues, and AMATILE S.L. will have an extension in the term to comply with them for a period of time equal to the duration of the force majeure event. AMATILE S.L. will use all reasonable means to find a solution that allows it to comply with its obligations despite the force majeure cause. AMATILE S.L. reserves the right to modify, at any time, and without prior notice, the presentation and configuration of the Website, its functionalities and/or the contents incorporated therein. The User expressly acknowledges and accepts that at any time AMATILE S.L. may interrupt, deactivate and/or cancel access to and/or use of the Website, without AMATILE S.L. being responsible for it.
